Jurors have now been deliberating for more than two hours in Jeffrey Malmberg’s second-degree murder trial in Kent County Circuit Court.
Defense attorney Jeffrey Kirchhoff has rested his case after calling Malmberg as his only witness.
Malmberg, 40, is accused in the Feb. 22 homicide of Jozlynn Martinez, the 2-year-old daughter of his live-in girlfriend, Connie Martinez.
Malmberg’s attorney argued that his statements that the death was an accident was the only evidence submitted by prosecutors.
Recordings show he underestimated the charges he would face for the girl’s death.
